Article 58 Of the Indian Constitution

Article 58 states the conditions a candidate must complete the eligibility criteria for election as President. As per this article, an individual cannot be eligible for election as President if they:

  1. Are not a citizen of India
  2. Have attained the age of thirty-five years
  3. Are not qualified for election as a member of the Lok Sabha (the lower house of Parliament)
  4. Are not qualified for election as a member of the Rajya Sabha (the upper house of Parliament)

A person shall not be eligible for election as President if he holds any office of profit under the Government of India or the Government of any State or under any local or other authority subject to the control of any of the said Governments.

Explanation: For this article, a person shall not be deemed to hold any office of profit by reason only that he is the President or Vice-President of the Union or the Governor of any State or is a Minister either for the Union or for any State.

If you are a citizen of India then you can participate in elections otherwise, you will not be able to do so. If the age of the candidate is less than 35, then he cannot participate in the election. The age of the candidate should be 36 years or more.

  • The candidate should be mentally fit, he should not be bankrupt and all his body parts should be healthy.
  • The candidate should not have been sentenced to more than 2 years of imprisonment before the election.
  • That candidate should be eligible to become a member of Lok Sabha, Rajya Sabha, or any lower house of Parliament.

If the candidate is a permanent employee in any company owned by the Government of India, then he/she cannot stand in the election for the President of India. If the candidate leaves the government job then he will again become eligible to participate in the election. But there are 56 government posts under which a candidate will still be eligible to contest the Presidential election while working. All these criteria are given in Article 58 of the Indian Constitution.
