We will start today’s blog with an interesting thing, we would like to tell you that the Vice-President of India has the same authority as the Vice-President of America. Yes, both have almost equal rights in their country. Article 68 of the Indian Constitution explains how the elections for the next Vice-President will be held and within what period. Let’s know about Article 68:

What Did Article 68 Mean?

The rules for how long someone can serve as vice president are written in Article 68 of the Indian Constitution. Article 68 includes the following details:

  • The process of electing a new Vice-President should begin and end shortly before the Vice-President is about to complete his 5-year term. And as soon as the term of the old Vice-President ends, the new Vice-President should be sworn in immediately.

However, if the Vice-President dies prematurely, dies due to old age, resigns, is removed from his position or the Supreme Court removes him from his position, it is mandatory to hold elections for another Vice-President as soon as possible. The day the newly selected candidate takes over the post of Vice-President, he will remain the Vice-President for 5 years from that day.

For example: If the Vice-President dies on 1 January 2024, then elections will be held as soon as possible after his death. And let us assume that a new Vice-President is elected on 1 January 2025, then he will hold this post for the next 5 years. That is, he will hold the post of Vice-President till 1 January 2030.

Let us tell you that in India, after the post of President, the biggest post is that of Vice-President as per the Indian Constitution. The tenure of this post is 5 years. If due to any reason the post of the President of the Barat becomes vacant, then the Vice-President holds the post of President until a new President is elected.

The procedure for the election of the Vice-President is described in Article 66. It states that the Vice-President will be elected by an electoral college consisting of members of both Houses of Parliament

Article 68 Of The Indian Constitution Definition

The terms of office for candidates chosen to fill the vice presidential post are framed in Article 68 of the Indian Constitution. The provisions of Article 68 are as follows:

Before the term’s expiration, an election must be held to fill a vacancy brought on by the Vice-President’s term coming to an end.

A Vice presidential vacancy brought due to his resignation, death, dismissal, or other cause shall be filled by election to be held as quickly as may be feasible after the vacancy occurs. Any individual chosen to occupy the position will have the right to retain it for the entire five years starting on the day he or she assumes office, subject to the provision of Article 67 of the Constitution.
