What Is Article 78 of the Indian Constitution In Simple Words

Article 78 of the Indian Constitution deals with how the President shall communicate with and pass information to the Vice-President. The Constitution of India is the most important law, without which nothing can run properly in India. It describes all the powers given to the government and it also describes how the executive, legislature, and judiciary will work. Let us understand Article 78 better in simple words:

Article 78 Of The Indian Constitution States

Duties of the Prime Minister as respect the furnishing of information to the President, etc. It shall be the duty of the Prime Minister:-

a. to communicate to the President all decisions of the Council of Ministers relating to the administration of the affairs of the Union and proposals for legislation;

b. to furnish such information relating to the administration of the affairs of the Union and proposals for legislation as the President may call for; and

c. if the President so requires, to submit for the consideration of the Council of Ministers any matter on which a decision has been taken by a Minister but which has not been considered by the Council.

Article 78 of the Constitution of India lays down the duties of the Prime Minister. Article 78 states, how can the Prime Minister communicate to the Vice-President and provide him with some information.

Article 78 Clause 1

The first clause of Article 78 states that the Prime Minister will discuss with the President any decision taken by the Council of Ministers for the functioning of the Union or for making a new law. The Prime Minister will give this decision to the President and then the President will decide whether to sign it or not.

Clause 2

If the President wants, he can ask for this information from the Prime Minister in which the Union is involved. If the Union is making plans to implement any policy or is making arrangements to implement any law, the President can ask for such information from the Prime Minister if he or she wants.

Clause 3

If the President wishes, he or she can place such a proposal in front of the Council of Ministers, asking them whether the decision has been taken by this Minister alone or all of you have also agreed to this decision.

For example, You all know that the Council of Ministers means a group of ministers. If Minister ‘A’ from the Council of Ministers takes a decision, then if the President wants, he or she can put a proposal in front of the Council of Ministers to tell whether this decision has been taken by all of you together or the Minister ‘A’ has taken this decision on a single basis.

In the end, Article 78 of the Indian Constitution specifies how the Prime Minister shall communicate with the President and what kind of information may be exchanged between the President and the Prime Minister.
