IPC Section 19 Definition
IPC section 19 states, that every person “who is empowered by law to give, in any legal proceeding, civil or criminal, a definitive judgment” is a judge. Both the expressions “legal proceeding” and “definitive judgment” have presented some difficulty in interpretation and require to be considered.
Section 19 Of IPC Explanation With Examples
A person who has been given the position of a judge by the government or law can give judgment, but some other people also have the right to give judgment, so who are those people? This is also explained in section 19 of IPC. If the law empowers any officer to give a judgment, whether it is a legal proceeding, civil or criminal, then he will also be called a judge. But there are some conditions in this. If someone gives a definite judgment to whom the power has been given by the law, then he/she will also be called a judge.

- Example 1: If a judge sentences person ‘A’ to death and after that, the High Court also approves the sentence, then we will consider the person who gave the verdict as a judge.
Example 2: There are several benches such as single, division, full, and constitutional benches. There is one judge in a single bench, there are 2 judges in a division bench, there are 3 in a full bench, and there are more than 3 in a constitutional bench. There can be 3, sometimes 5, sometimes 7, and sometimes 9 or even more judges in a constitutional bench. If any bench passes a final judgment, then all the officials who gave the decision will be called judges.
Example 3: Now if there is a Magistrate, when will he be called a Judge, when will those who make decisions in the Family Court be called Judges, when will the Rent Controller also be called a Judge? So they will be called only when the final decision is passed and no appeal has been made against it.
