Section 505 Of IPC: Classification Of Offence

As per Section 505, if anyone spreads fake stories or statements to do wrong things such as to start a fight within the country, to rise bad things against official authorities, to instill a sense of danger in the minds of military personnel, to begin a crime against the State or general peace, or to make people of two religions fight with each other will charge with imprisonment up to 3 years, fine, or both. Section 505 Of IPC: Classification Of Offence

• If a person propagates bad things thinking that it may disturb the peace of common people or cause any harm, then so in this case that person can be punished with 3 years imprisonment, a fine, or both. It is a non-cognizable and non-bailable crime.

• If an individual spreads wrong and hateful speech between two different religions. In this case, the person will serve 5 years in imprisonment, a fine, or both. It is a cognizable and non-bailable crime.

Section 505 IPC: Statement Conducing Pubic Mischief

Any individual who broadcasts publishes any hateful speech or statement:

• To cause bad situations for any officers such as soldiers, sailors, or airmen in the Army, Navy, and Air Force; or

• To destroy the government authorities or public peace such as to create a feeling of fear in people’s minds, to give wrong messages so that people do wrong things and cause harm to the government; or

• To encourage somebody to do something by making him/her very angry, creating conflict between two groups, or inciting people of two religions towards violence.

In sub-section 2, if any individual or group does the same crime but in a place of worship, etc.

Anyone who is engaged in spreading false speech and statements in any religious place, when a group gathers together and worships, will be charged with imprisonment for up to 5 years, a fine, or both.

Section 505 has been implemented so that no person can spread wrong feelings and create a rift between any two religions, and can not harm army officers, navy officers, air force officers, soldiers peace of mind, etc.

Charges for offenses under Section 505?

There are particular crime charges for different-different possibilities of the crime:

• Minimum 3 years of jail, a fine, or both if a person tries to spread false information to destroy public mental peace and harmony.

• More than 3 years of imprisonment, a fine, or both if a person stimulates hate or bitterness between two religions.

• Minimum 5 years of imprisonment, a fine, or both if a person stimulates hate or bitterness between two religions in a place of worship.
